Welcome to www.chinamallexpress.co.za (the “Website”), an e-commerce platform operated by China Mall Express (PTY) Ltd (“China Mall Express”, “we”, “us”, “our”). We specialize in helping China Mall shop owners list and sell their products online via our multi-vendor marketplace. These Terms and Conditions (“Terms”) govern your access to and use of our Website, and the purchase of goods listed by third-party vendors (“Vendors”). By accessing or using the Website, you agree to be bound by these Terms. If you do not accept these Terms, please do not use the Website.
2.1. Only registered users may purchase goods on our Website.
2.2. You must be 18 years or older and legally capable of entering a binding agreement to register and use the Website. If you are under 18, you may only use this Website under the supervision of a parent or legal guardian
2.3. You are responsible for maintaining the confidentiality of your login credentials. You accept responsibility for all activities under your account.
2.4. You agree not to use any device, software or routine to interfere or attempt to interfere with the proper working of the Website.
3.1. China Mall Express operates as a marketplace and facilitates the sale of products between Vendors and customers.
3.2. Each Vendor is responsible for the description, pricing, availability, and fulfilment of goods. We do not guarantee the accuracy of product listings or Vendor commitments.
3.3. Any dispute relating to goods sold by a Vendor must be resolved directly between you and the Vendor, unless otherwise specified in our support policy.
4.1. You may place orders for goods on the Website. These may be accepted or rejected by the Vendor, based on availability, accuracy of product details, and successful receipt of payment via PayFast.
4.2. A sale is concluded only when:
Goods are dispatched for delivery; or
You receive confirmation of dispatch from China Mall Express or the relevant Vendor.
4.3. If any goods become unavailable after an order is placed, you will be refunded in full.
5.1. All payments are processed securely through PayFast (Pty) Ltd, a South African payment gateway. Your financial information is handled according to PayFast’s privacy and security policies.

5.3. We do not store any credit or debit card details on our servers. All transactions are encrypted and processed through PayFast's secure infrastructure.
5.4. You are responsible for ensuring that your payment details are accurate and that sufficient funds are available.
6.1. All deliveries are facilitated through The Courier Guy and subject to their standard delivery policies and terms.
6.2. Delivery options and estimated times will be shown at checkout. We aim to ensure delivery within 7-10 working days, but actual times may vary based on the Vendor’s location and fulfilment speed.
6.3. A flat or dynamic delivery fee may apply and will be displayed during checkout.
6.4. Our obligation to deliver is fulfilled when the item is delivered to the address you provide. We are not liable for loss or theft after successful delivery.
7.1. You may cancel an order before dispatch. Once an order has been dispatched, returns will be handled in accordance with our Returns and Refund Policy, available on the Website.
7.2. Return requests must be initiated within 7 days of receiving the item. The item must be unused and in its original packaging.
7.3. Some Vendors may have their own specific return, exchange, or refund policies. Additionally, certain goods—such as perishable items, customized products, or personal use items—may not be eligible for return, exchange, or refund unless they are faulty or damaged on delivery.
7.4. China Mall Express will facilitate communication but is not responsible for guaranteeing acceptance of returns or refunds for such goods where restrictions apply.
7.5. Approved refunds will be processed through PayFast within 5–10 business days, subject to inspection and approval.
You may not:
Use the Website for unlawful purposes.
Post or distribute offensive, defamatory, or fraudulent content.
Infringe on any intellectual property or proprietary rights.
9.1. We do our best to ensure accurate content and reliable service, but we do not guarantee uninterrupted access or error-free operation of the Website.
9.2. China Mall Express is not liable for:
Any loss arising from reliance on third-party information;
Delay in delivery beyond our control;
Actions of third-party vendors or delivery partners.
9.3. You indemnify China Mall Express against any loss or damages caused by your breach of these Terms.

These Terms are governed by the laws of the Republic of South Africa. Any disputes shall be resolved in South African courts.
